SaaS terms of service template
Terms of service are a contract, not a store form, so no single official source dictates their wording. This page lists what to keep consistent and gives a free excerpt of template wording.
What to keep consistent
- If you sell through a store or payment platform, read that platform's current refund rules and make your refund field agree with them.
- Point the terms to your privacy policy, and make what they say about data match it. For what that policy must say, see the SaaS privacy policy page.
- Consumer protection law in many places limits what a clause can take away from consumers, whatever the terms say. For example, EU consumer rules are summarised on Wikipedia; they differ by country.
Free excerpt from the template
Four complete clauses, copyable as plain text. Replace every [[FIELD]].
1. Payment and renewal Paid plans are billed [[BILLING_PERIOD]]. Fees are due in advance, exclude taxes unless stated, and renew automatically until you cancel. You can cancel at any time in your account; cancellation takes effect at the end of the current billing period. 2. Refunds [[REFUND_TERMS]] Nothing in this section limits refund or withdrawal rights that the law gives you as a consumer. 3. Your content You keep ownership of the content you upload. You give us a limited licence to host, process and display it only to run the Service for you. You are responsible for having the rights to your content. 4. Limit of liability To the extent the law allows, our total liability to you for all claims about the Service is limited to: [[LIABILITY_CAP]] We are not liable for indirect or consequential loss such as lost profits or data. This does not limit liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.
